Terms of Service

1.1These Terms of Service (“Terms”) govern access to and use of ofmop.org, related subdomains, mobile surfaces, maps, listings, APIs, and OFMOP-operated features (together, the “Platform”), operated under the brand OFMOP (“OFMOP”, “we”, “us”, “our”).

1.2OFMOP is a community information and discovery platform for Jamaica. It helps users explore transport (including bus, taxi, and related route information), fuel prices, real estate listings, facilities (such as hospitals, schools, police and fire stations, and similar points of interest), local services and commerce, and community notices and alerts, often organised by parish and district and shown on an interactive map.

1.3Unless content is clearly marked as original OFMOP material, much of the Platform aggregates, displays, or links to information from third parties (including users, businesses, agents, transport operators, and public or licensed data sources). OFMOP does not guarantee that every listing, price, route, facility detail, or notice is complete, current, or error-free.

1.4OFMOP is not a law firm, estate agent, transport operator, emergency service, or government authority. Information on the Platform is general and is not professional legal, medical, financial, or safety advice.

1.5Ownership and control: OFMOP does not publish operator or beneficial-ownership details on the public site. For ownership disclosure or related corporate enquiries, email [email protected] with the subject Ownership Disclosure Request and enough detail for us to respond lawfully. We answer only as permitted by law and our records.

1.6Companion products (including Abeng, Jurifi, Captureland, Inbox, and Matsil) may be operated separately. Your use of them is governed by their terms and policies unless we say otherwise in writing.

2.1By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

2.2Where the Electronic Transactions Act applies, electronic acceptance (including clicking “I agree”, creating an account, or continuing to use the Platform after notice) has the same effect as a written signature.

2.3We may change these Terms. For material changes, we will give at least 30 days’ notice by email to registered users (where we have an address) and/or a prominent on-site notice before the new effective date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Platform and close your account.

3.1Some features may be available without registration. Other features (including fuller map access, saved preferences, listings, or authenticated services) may require an account.

3.2You must be 18 or older to create an account. The Platform is not directed at children under 18.

3.3You are responsible for activity under your account, for keeping credentials secure, and for accurate registration information.

3.4We may suspend or terminate accounts for breach of these Terms, abuse, unlawful use, misleading listings, or risk to the Platform or third parties, with or without notice where reasonably required.

4.1The Platform may request device location to show nearby routes, facilities, listings, notices, or map markers. You may refuse or withdraw location permission in your browser or device settings; some features may then be limited.

4.2Map markers, routes, prices, facility records, and similar data may come from users, partners, public sources, or automated feeds (including fuel pricing attributed to sources such as JAA where shown). Display on OFMOP does not mean we operate, endorse, or warrant every business, vehicle, property, or facility shown.

4.3Real estate listings may include photos, prices, and agent or seller details supplied by third parties. OFMOP is a listing and discovery channel, not a party to any sale or lease unless we expressly say so in writing.

4.4Transport information (including routes, stops, and tracking features where available) is for planning and convenience. It is not a substitute for operator timetables, official notices, or on-the-ground safety judgment. Service levels, fares, and availability can change without notice.

4.5Notices and alerts may include community or official-style updates. Verify safety-critical or emergency information through appropriate official channels. OFMOP is not an emergency dispatch service.

4.6We may correct, update, moderate, or remove map content, listings, or notices for editorial, legal, technical, accuracy, or rights reasons.

5.1Third-party names, logos, listings, images, and data remain the property of their respective rights holders. OFMOP claims rights in its brand, software, selection, layout, and original material.

5.2Subject to these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal or internal organisational community and local-information purposes.

5.3You must not:

• scrape, harvest, or bulk-download the Platform in a way that impairs our systems or circumvents technical limits;
• remove attribution or misrepresent the source of data;
• use the Platform to build a competing dataset or train models on our content without written consent;
• republish substantial Platform content commercially without permission from the relevant rights holder and, where required, from OFMOP.

5.4The Copyright Act and applicable fair dealing or licensing principles apply to reuse. Rights concerns: [email protected] (subject: Rights-Holder Complaint).

6.1If you submit listings, business profiles, notices, tips, reviews, images, or other material (“User Content”), you represent that you have the right to submit it, that it is accurate to the best of your knowledge, and that it does not violate law or third-party rights.

6.2You grant OFMOP a worldwide, royalty-free licence to use, reproduce, adapt, publish, display, and distribute User Content to operate, promote, and improve the Platform and to show it on maps and parish or district views, subject to the Privacy Policy.

6.3You must not use the Platform to:

• violate Jamaican or applicable foreign law;
• publish false, misleading, or fraudulent listings or prices;
• defame, harass, threaten, or invade privacy;
• upload malware or attempt unauthorised access;
• impersonate others or misrepresent affiliation with a business, agency, or transport operator.

6.4We may remove User Content and restrict access at our discretion. We are not obliged to monitor all User Content.

7.1The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, OFMOP disclaims warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement in respect of third-party and user-supplied content.

7.2We do not guarantee uninterrupted or error-free service. Routes, prices, listings, and facility details may be delayed, incomplete, or later corrected at the source.

7.3Property, transport, health, legal, and official information on the Platform is general information only. Verify with qualified professionals and primary sources before acting.

8.1To the fullest extent permitted by Jamaican law, OFMOP is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from use of the Platform.

8.2Our aggregate liability for claims relating to the Platform (other than liability that cannot be excluded by law) is limited to the greater of (a) JMD 50,000 or (b) the fees you paid OFMOP in the twelve (12) months before the claim. For free use, (b) may be zero.

8.3These limits do not apply to death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.

8.4Where a third-party business, agent, landlord, transport operator, or user supplies the underlying listing or information, primary responsibility for that material remains with them, except where OFMOP has independently caused loss through its own deliberate wrongdoing or negligence.

You agree to indemnify and hold harmless OFMOP and its operators from claims, losses, and reasonable costs (including legal fees) arising from your User Content, your breach of these Terms, or your unlawful use of the Platform, except to the extent caused by OFMOP’s deliberate wrongdoing or negligence.

10.1The Platform may link to businesses, agents, government sites, maps, and companion products. We do not control and are not responsible for their content, terms, or privacy practices.

10.2Your use of linked services is governed by their terms and policies.

11.1These Terms are governed by the laws of Jamaica.

11.2The courts of Jamaica have non-exclusive jurisdiction, subject to mandatory consumer or constitutional provisions.

11.3Before formal proceedings, the parties will attempt good-faith negotiation for 30 days after written notice to [email protected]. Either party may then refer the dispute to mediation through the Dispute Resolution Foundation (or successor). Arbitration under the Arbitration Act 2017 applies only by written agreement of the parties.

12.1If any provision is invalid, the remainder stays in effect.

12.2Failure to enforce a provision is not a waiver.

12.3You may not assign your rights without our consent. We may assign our rights in connection with a reorganisation or sale of the Platform.
